Ownership of Site; Agreement to Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Colour Yoga website located at www.colouryoga.com, as well as all associated sites, mobile sites, applications, platforms, services, and tools (collectively, the “Site”). In addition, these Terms govern your participation in any in-person classes, workshops, events, or other activities operated by Colour Yoga (collectively, the “Services”).

In these Terms, “Colour Yoga,” “we,” “us,” or “our” refers to Colour Yoga and its subsidiaries and affiliates. “You” or “your” refers to any individual who accesses, browses, uses the Site, or participates in any Services.

By accessing or using the Site, or by participating in any Services, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Site or participate in the Services.

PLEASE READ THESE TERMS OF USE CAREFULLY. BY ACCESSING OR USING THIS PROGRAM, YOU AGREE TO BE BOUND BY THE TERMS DESCRIBED HEREIN AND ALL TERMS INCORPORATED BY REFERENCE. IF YOU DO NOT AGREE TO ALL OF THESE TERMS, DO NOT PARTICIPATE IN THIS PROGRAM.

Health Warranty

You acknowledge that the participation in physical exercise naturally involves the risk of injury. You further acknowledge that specific risks include injuries resulting from overexertion, physical adjustment, improper or negligent use of recommended equipment (e.g.blocks and/or straps), failure to follow trainer instructions, or injuries resulting from participation in an inappropriate level of physical exercise. As such, you understand and voluntarily accept these risks and agree that you are solely responsible for selecting classes and activities that are appropriate for your skill and ability level.

It is your responsibility to inform the instructor of limitations before class begins. Practise includes physical movements as well as an opportunity for relaxation, stress re-education and relief of muscular tension. As is the case with any physical activity, the risk of injury, even serious or disabling, is always present and cannot be entirely eliminated. If you experience any pain or discomfort, you will listen to your body, discontinue the activity, and ask for support from the instructor. You assume full responsibility for any and all damages, which may incur through participation. Our practices are not a substitute for medical advice, diagnosis, or treatment.

Certain exercises may not be safe or recommended under specific medical conditions. By using the Site, attending class in person or via Zoom or other media, you affirm that you are fit to participate in such a fitness program. In addition, you will make the instructor aware of any medical conditions or physical limitations before class. If you are pregnant, become pregnant or you are post-natal or post-surgical, your use of the Site and participation in class confirms that you have your doctor‘s approval to participate. You also affirm that you alone are responsible to decide whether to practice and participation is at your own risk. You agree to irrevocably release and waive any claims that you have now or may have hereafter against us, its owners, officers, employees, and instructors.

Indemnity

You hereby agree to defend, indemnify and hold us harmless from, and you covenant not to sue us for, any claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including, without limitation, lawyers’ fees) arising from or related to (a) your negligence, error, omission or willful misconduct, (b) your breach of any terms of this Agreement, or (c) your use of the Site or the Materials.

Reservation

1. Program Overview

   Classes are always subject to availability, but at Services we will always do our best to accommodate you in your chosen class.

   All classes must be prepaid. Any Introductory offer starts from the date the payment is made.

   Reservations must be made online. Class size is limited and Services operates a “first come first served” booking policy. Online booking takes priority over people who drop in. Out of consideration for the instructor and other students, please be aware that if you are more than 10 minutes late for a class, you may not be able to participate.

   Classes start promptly at the advertised times. Students need to arrive at the Studios with enough time to change and enter the studio before the class starts. Students arriving at studio once the instructor has started class may not be allowed to attend that class despite the above policy and this is at the discretion of the individual teacher.

   Details of class times at the Studio may vary from time to time. Classes will be published by the Studio and will be available at the Studio or on our Website.

2. Reservation Policy

   On making a booking with us, each person travelling must accept the terms of these Reservation Policy.

   You must have an active plans to make a reservation. Orders that are still on pending and on-hold status are not confirmed until payment is completed to make a reservation.

   Bookings must be made at least 36 hours before the class begins. These hours are also effective on any holidays prior the date and time of the class.

   Booking time will ended 3 hours prior to the class start time.

   With exception for morning classes (those starting before 12:00am), booking time will ended on the previous 1 day prior the class date at 21:00pm. Example to this, if a class will start on Monday 08:00am, then the booking time will ended on Sunday at 21:00pm for all morning classes.

   Class reserve cancellations are accepted up to 4 hours prior to your class start time without penalty. Students using class pack who pre book a class but cancel the booking less than 4 hours prior to the class start time will considered present.

   Class reserve cancellations for morning classes are accepted up to 20:00pm on 1 day prior the class date. Students using class pack who pre book a class but cancel the booking after 20:00pm will considered present.

   Students who use class packages who book classes but do not attend and do not cancel bookings will still be considered attending and will reduce the capacity of their class packages.

   For students who have an unlimited package who book classes but do not attend and do not cancel bookings, students will not be able to make a reservation for 7 days from the date of absence.

   Any students who regularly books online and fails to show up for class without cancelling might be blocked from our online booking system.

   Minimum students to make a class available is depend on type of class and can be known after the reservation is received. Once the booking time ended and total reservation was below the minimum, the class will be cancelled, even the online schedule indicate that the class exist.

Rewards Policy

1. Basic information

   Site Rewards is operated solely by us, we are not using any third party service. By using the Referral and Points Program, you agree to the below mentioned terms of service of the Program. If you do not agree with these terms of service, you cannot continue using the services.

2. Program Overview

   The Site Rewards ("Rewards Program") is our way of saying thanks to you, our customers, for being loyal our patrons. The Rewards Program is a loyalty program which is operated by us. The Rewards Program allows participants who registered as customers to use their Points to collect Rewards and sharing personal link and earns coupons using Referral Program.

   These Terms apply to your access to, and participation in, the Rewards Program. Your participation in the Rewards Program confirms your acceptance of these Terms and any changes or modifications, as provided for below; therefore, you should review these Terms and applicable policies frequently to understand the terms of service that apply to the Rewards Program. If you do not agree to the Terms, you must stop participating in the Rewards Program.

3. Eligibility for the Rewards Program

   Membership in the Rewards Program is limited to individuals only and who are 13+ at the time of entry. No corporation, trust, partnership or other entity may hold membership in the Rewards Program. The Rewards Program is offered for personal use only, and is not for commercial or other business use.

   You must have reached the age of thirteen (13) to participate in the Rewards Program. If you are between the ages of 13 and the age of majority in your province/territory of residence, you must have the permission of your parent/legal guardian to participate in the Rewards Program.

   A Rewards Program member must enroll individually, using his/her full legal name to open a Rewards Program account ("Account"). If you have lost your balance protection registered Rewards account and need assistance, you need to contact us to recover your access. Only an active, registered Rewards account is eligible to earn points and referral coupons, except as may be permitted by us in its sole and absolute discretion.

   There is a limit of one (1) Account per eligible individual/email address. Membership is solely for the benefit of the individual who opened the Account, and all Accounts must be maintained in the name of the individual who first opened them. When you enroll in the Rewards Program you agree to receive the information and notifications regarding your participation in the Rewards Program from us. You may also choose to receive other communications from us, including our newsletter, and/or special offers about the Rewards Program, and its rewards and services.

4. Registering for the Rewards Program

   To sign-up for the Rewards Program, and begin earning Rewards Program points ("Points") simply have your first purchase on Site plans and activate your account. You may keep track of your Points and Rewards, monitor and add to your Account balance. Before you may earn Points on a Rewards, as provided in rule 5 of these Terms, you must activate your Account.

   We will not be liable for any misdirected email or other communications, including any notices under these Terms, or for any consequences thereof, if your Account information is inaccurate or no longer valid. You are responsible for ensuring that you can receive messages or notifications from us at the contact information you provide. If we believe that some of our records are inaccurate, we may contact you to verify our records. We reserve the right to cancel any Account for which we determine we have incomplete or inaccurate information and in such a case any Points or Rewards (defined below) associated with such Account and the Rewards account associated with it may be forfeited. The submission of false or fictitious information may result in all Points or Rewards associated with such Account and the Coupons associated with it being forfeited.

   All Rewards Program registrations are subject to verification at any time and for any reason. We reserves the right, in its sole and absolute discretion, to require proof of identity and/or eligibility (in a form acceptable to us - including, without limitation, government issued photo identification): (i) for the purposes of verifying an individual’s eligibility to participate in the Rewards Program; and/or (ii) for any other reason we deems necessary, in its sole and absolute discretion, for the purposes of administering the Rewards Program in accordance with these Terms. Failure to provide such proof to the satisfaction of us in a timely manner may result in the cancellation of your Account and in such a case any Points or Rewards or Referral (defined below) associated with such Account may be forfeited.

5. Earning Points

   Point Rewards Program benefits are determined based on the amount of money you spend on eligible purchases at our website only. All purchases at our website are "Eligible Purchases" with the exception of promotional purchases and certain plans that we indicates are not eligible for participation in the Point Rewards Program.

   You must have an active account and acceptance of the agreement at the time you pay for your Eligible Purchase to earn Points or Coupon Rewards. No Points or Coupons will be rewarded if you did not accept this terms and condition at the time you completed your Eligible Purchase. Terms for new customers not to receive reward points other than subsequent purchases are non-binding, depending on the state of the ongoing promotion method.

   For each Rp 25,000 you spend at a participating our plans you’ll earn 1 Point. For example:

   If you spend Rp 250,000 you’ll earn 10 Points.

   If your spend includes units that can not evenly divided by Rp 25,000, the unit are not count as points. For example, if you spend Rp 410,000 you’ll earn 16 Points.

   Points are calculated based on the selling value of a product. If you shop for more than one product, then the points are not calculated from the sum of your total purchases.

   At any point during the Rewards Program, we may issue special promotions that alter the rate at which Points are earned, such as Point Multipliers, Bonus Points, or other promotional offers on certain products, services, days, or portions of any day. We may make such promotional offers to all Rewards Program participants, or any subset of them, in its sole and absolute discretion. We may communicate issuance of these promotional offers via Rewards. These Terms shall apply to such offers, along with any additional terms of service that accompany the offer, unless you are notified otherwise.

   You can view your accumulated Point balance at any time by visiting Rewards by logging in to your Account using your Registration information. Additionally, you may ask the sales associate when presenting your Rewards at a our Location for your balance, or for a Rewards Program transaction receipt.

6. Points are for promotional purposes only and have no cash value.

   All decisions of Colour Yoga with respect to Points (including, without limitation, the accuracy of a participant’s Point total and/or the validity of any Points) are final and binding on all participants without right of appeal. Points have no cash value and are not exchangeable for cash. Points have no value outside of this Rewards Program. Points cannot be sold. Points cannot be assigned, transferred, exchanged, traded, bartered, purchased, bequeathed, given by gift except as may be permitted by us in its sole and absolute discretion. Any Points acquired in violation of these Terms are void. The accumulation of Points does not entitle the participant to any vested rights, and we does not guarantee in any way the continued availability of any reward or any other benefit.

   All Points are subject to verification at any time for any reason. We reserves the right, in its sole and absolute discretion, to invalidate any Points it deems to have been awarded in error, or as the result of any fraudulent activity, or any activity not in keeping with the letter and/or spirit of these Terms, as interpreted by us in its sole and absolute discretion. Any Points that cannot be verified to the complete satisfaction of Colour Yoga are subject to disqualification. We will not be liable for the failure of any Points to be captured or recorded for any reason.

   As may be permitted under the applicable law, Points are reduced to zero (0) upon closure of an Account (regardless of the reason for Account closure). Upon the death of a participant, the associated Account will be closed and any Points in the Account will be forfeited. Points are reduced to zero (0) upon the termination of the Rewards Program. We may terminate your Account, this agreement with you, and reduce your Points which were issued to you to zero (0), if your Account becomes and remains inactive for a period of six (6) month or more, or any longer period specified by applicable law. An inactive account means, among other things, not making any transactions at Site, not attending classes even though your package is still valid while the Studio actively provides services both physically or virtually. If due to printing, production, online, internet, computer or other error of any kind, more Points are claimed or credited to an Account than intended to be distributed according to these Terms (including without limitation any Bonus offer terms), then, in addition to having the right to terminate the Rewards Program immediately, we reserves the right, in its sole and absolute discretion, to rescind invalid Points claims, or to deduct such invalid Points from the applicable Account(s).

Pricing and Refund

All prices are quoted in Indonesian Rupiah (IDR) and all transactions are processed in Indonesian Rupiah (IDR).

Prices, products and offers include TAX.

All prices are correct at the time of online publication at the our website. Prices are subject to change without notice.

Sale items are only available at the lower price during the sale period.

We reserve the right to amend prices and printing errors.

Prices may increase from time to time to reflect increases in cost and benefits.

All purchases are final. We does not offer refunds or redemptions of any kind, including injuries both in the studio and outside the studio, illness, pregnancy, change of address or any other reason including earthquakes, floods, fires, national emergencies, unpredictable and prolonged loss of electrical power, outbreak of epidemic/pandemic of infectious diseases, and periods of prolonged political instability.

All passes and memberships are non-transferable.

We reserves the right to pass on the cost of any additional bank fees which may incur from disputed or failed transactions regarding a students account.

Media Capture and Usage

You acknowledge and agree that we may capture photographs, audio, or video recordings (“Media”) during classes, events, or while you are using our facilities. This Media may be used for promotional, educational, or quality assurance purposes. By using our services or attending our events, you agree to the following terms regarding Media capture and usage:

• You grant us permission to capture Media that may include your image or voice.
• You grant us a worldwide, royalty-free, perpetual, irrevocable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such Media in any form, format, or medium now known or later developed.
• This Media may be used in our marketing materials, social media, website, or other promotional channels without further notification or compensation to you.
• We may use this Media for internal training or quality assurance purposes.
• If you prefer not to be included in such Media, you must inform our staff before participating in classes or events. While we will make reasonable efforts to honor such requests, we cannot guarantee that you will not appear in the background of some Media.
• You waive any right to inspect or approve the finished product wherein your likeness appears.
• You agree that you have no claim to additional consideration or accounting, and that you will make no claim for any reason against us regarding the use of this Media.

If you have concerns about appearing in our Media or wish to have specific Media removed, please contact us using the information provided at the end of these Terms. We will consider such requests on a case-by-case basis but are under no obligation to honor them.

Acceptance of Terms

You have read, fully understood and agree to the terms of this Agreement and Release of Waiver of Liability. By using the Site, booking and participating in its classes, you are entering into this agreement voluntarily and recognize this complete and unconditional release of all liability to the greatest extent allowed by law.

Feedback and Information

Any feedback you provide at this site shall be deemed to be non-confidential. Colour Yoga shall be free to use such information on an unrestricted basis.
